Aniyor Marketplace - Terms of Service

Welcome to Aniyor, a marketplace platform designed to connect buyers and sellers within the ISKCON devotee community ("Aniyor," "we," "us," or "our"). By accessing or using the Aniyor platform (the "Platform"), including our website, mobile applications, and any related services, you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Platform.

1. Acceptance of Terms

By accessing or using the Platform, you confirm that you are an ISKCON devotee and that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Platform

Aniyor is a platform that facilitates transactions between buyers and sellers of products and services related to the ISKCON community. Aniyor is not a party to the transactions between buyers and sellers. We provide a venue for sellers to list their products and services and for buyers to browse and purchase them.

3. Eligibility

• Account Registration: You may be required to create an account to access certain features of the Platform. You agree to provide accurate, complete, and current information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities that occur under your account.

4. Seller Terms

If you are a seller on the Platform, you agree to the following:

• Accurate Listings: You are solely responsible for the accuracy and content of your product and service listings. You must provide accurate descriptions, prices, and any other relevant information.
• ISKCON Affiliation: You confirm that you are a practicing ISKCON devotee and agree to provide evidence of such if requested by Aniyor.
• Legal Compliance: You agree to comply with all applicable laws and regulations in your jurisdiction regarding the sale of your products and services.
• Transaction Responsibility: You are responsible for fulfilling your transactions with buyers, including providing the products or services as described and handling any customer service issues.
• Pricing and Fees: You are responsible for setting the prices for your products and services. Aniyor may charge fees for using the Platform, and you agree to pay any such fees as outlined in our Fee Policy (if applicable).
• Service Guarantees and Return Policies: You are responsible for clearly defining and adhering to your own service guarantee periods (0, 3, 7, or 15 days) and product return policies (non-returnable, or returnable within 7, 15, or 30 days). You will be solely responsible for any refunds or exchanges as per your policy.
• Prohibited Items and Services: You may not list any products or services that are illegal, offensive, or violate Aniyor's policies.
• Intellectual Property: You warrant that you have the right to sell the products and services you list on the Platform and that they do not infringe upon the intellectual property rights of any third party.
• Indemnification: You agree to indemnify and hold Aniyor harmless from any claims, losses, or damages arising out of your use of the Platform, including but not limited to any claims related to your products, services, or violation of these Terms.

5. Buyer Terms

If you are a buyer on the Platform, you agree to the following:

• ISKCON Devotee Status: You confirm that you are a practicing ISKCON devotee.
• Purchase Responsibility: You are responsible for your purchases on the Platform. You agree to pay the agreed-upon price for any products or services you purchase.
• Review Seller Policies: You are responsible for reviewing the seller's specific service guarantee and return policies before making a purchase.
• Communication: You agree to communicate with sellers directly to resolve any issues or concerns regarding your purchases.

6. Disclaimer of Warranties

ANIYOR PROVIDES THE PLATFORM ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ANIYOR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE PLATFORM IS ACCURATE, COMPLETE, OR CURRENT.

ANIYOR IS NOT RESPONSIBLE FOR THE ACTIONS OR INACTIONS OF ANY SELLER OR BUYER ON THE PLATFORM. ANY TRANSACTIONS ARE SOLELY BETWEEN BUYERS AND SELLERS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANIYOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ANIYOR'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT OF FEES PAID BY YOU TO ANIYOR IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Aniyor, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the Platform.
• Your violation of these Terms.
• Your transactions with other users.
• Your content.
• Any claim that your content infringes any intellectual property right or other right of any third party.

9. Intellectual Property

The Platform and its content, including but not limited to text, graphics, images, logos, and software, are owned by Aniyor or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works of the Platform or its content without our prior written consent.

10. User Content

• Content Responsibility: Users are solely responsible for the content they post or submit on the Platform ("User Content").
• License to Aniyor: By posting User Content, you grant Aniyor a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with the operation of the Platform.
• Prohibited Content: You may not post any User Content that is illegal, offensive, defamatory, infringing, or violates these Terms.
• Right to Remove: Aniyor has the right to remove or disable any User Content that violates these Terms or that we deem objectionable, without notice.

11. Dispute Resolution

• Mediation: In the event of any dispute between you and Aniyor, you agree to first attempt to resolve the dispute through good-faith mediation.
• Governing Law: These Terms and any dispute arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of Mumbai, without regard to its conflict of laws principles.
• Venue: Any legal action or proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the courts of [Your Jurisdiction].

12. Termination

Aniyor may terminate or suspend your access to the Platform at any time, with or without cause, and without notice. You may also terminate your account at any time.

13. Modifications to Terms

Aniyor may modify these Terms at any time by posting the revised Terms on the Platform. Your continued use of the Platform after the posting of the revised Terms constitutes your acceptance of the changes.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

15. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by Aniyor.

16. Entire Agreement

These Terms constitute the entire agreement between you and Aniyor regarding your use of the Platform and supersede all prior agreements and understandings, whether oral or written.
